Section A: General Rules & Regulations

Whether you are using This Place Matters to crowdfund for a project, participating in a competition, funding or voting for a project, these general rules apply.

 

Section B: Rules & Regulations for Funders

These rules apply to people who are funding projects, whether they are crowdfunding projects or projects participating in a competition.

 

Section C: Rules & Regulations for Crowdfunders

These rules apply to project groups using This Place Matters to crowdfund, whether they have posted crowdfunding campaigns, or are participating in a competition.

 

 

Section D: Rules & Regulations for Competitions 

These rules apply to project groups participating in a competition on This Place Matters and to voters supporting projects in a competition. Please note these rules are only posted when there is a competition available.

Section A: General Rules & Regulations

 

  1. This Place Matters.ca is owned by the National Trust for Canada. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans, representations and photographs are owned by the National Trust. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of the National Trust is strictly prohibited. This Place Matters® is a registered trademark of the National Trust for Canada.
  2. All project groups are responsible to ensure that the content [including copy, photos and videos] posted to their Project Page does not infringe on any copyrights, trademarks, rights of privacy, or intellectual property rights of any person or entity.
  3. Any content posted by a project group to their Project Page [including copy, photos and videos] deemed by the National Trust to be objectionable or inappropriate will be removed and the project group may be disqualified from crowdfunding or competing on This Place Matters at the discretion of the National Trust.
  4. No Project Group shall make use of the National Trust logo or This Place Matters logo on any materials promoting their participation in a crowdfunding campaign or competition without the express consent of the National Trust. Where consent is granted, the National Trust must approve the materials prior to their production and distribution.
  5. The contact person for the project group indicated on the registration form will be recognized as the official representative acting on behalf of the project group for all matters related to the use of the website.
  6. The National Trust is not responsible for incorrect or inaccurate transcription or entry information, technical malfunctions, lost, delayed or misdirected data transmissions, telephone network failures, failure of computer equipment or software, inability to access any online service or website, inability to submit online, or any other error or malfunction, or any injury or damage to the project groups’ or any other person’s computer related to participation on This Place Matters.
  7. If a project group withdraws from a crowdfunding campaign or a competition, is disqualified, or for any reason the project does not proceed, the funds contributed to that project will be transferred to the National Trust and directed to our programs that ensure community groups working to save places that matter have the tools and resources they need to succeed.
  8. The National Trust reserves the right to cancel, amend, or suspend activities on This Place Matters in any way without prior notice or obligation in the event of an error, technical problem, computer virus, tampering, fraud, technical failure, or any other cause beyond its reasonable control that interferes with the proper conduct of the activities.
  9. By participating in a crowdfunding campaign or a competition, project groups, funders, and voters agree to abide by the Rules & Regulations and the decisions of the National Trust which are final and binding in all matters.
  10. All times noted are in Eastern Time [ET].

 

Section B: Rules & Regulations for Funders

 

  1. Names of funders, their contact information and the amounts contributed will not be posted on the project group’s Project Pages or made available to the public anywhere on the website.
  2. Names of funders, their contact information and the amounts contributed will only be disclosed to the project group with the express consent of the funder.
  3. The National Trust will only acknowledge the names of funders in its materials that recognize supporters with the express consent of the funder.
  4. All contributions are payable to the National Trust.
  5. Receipt of all contributions will be verified by an e-mail receipt. Where the project group is a registered charity, the National Trust will issue a charitable tax receipt for the full amount of the contribution.
  6. By contributing to any project the funder consents to the collection, use and distribution of his/her personal information by the National Trust for the purposes of implementing, administering and fulfilling the crowdfunding campaign or competition. The National Trust will not sell or transmit this information to third parties except for the purposes of administering the crowdfunding campaign or competition without the express consent of the funder.
  7. By contributing to any project the funder consents to the manner of collection, use, and disclosure of personal information as set out in the National Trust’s Privacy Statement which is available at nationaltrustcanada.ca.

Disclaimer

 

This Place Matters was developed by the National Trust as a resource for community groups working to save places that matter to raise funds to support their heritage projects. Through a set of strictly enforced Eligibility Requirements and a registration process we make every effort to ensure that the money raised will be directed to the projects as described by the project groups. The National Trust is not responsible for the projects themselves, or for their outcomes. We encourage funders to read the Eligibility Requirements.

 

Section C: Rules & Regulations for Crowdfunders

 

  1. Project groups wishing to crowdfund on This Place Matters must first complete and submit the registration form.
  2. The National Trust reserves the right to disqualify a project from crowdfunding on This Place Matters if any of the eligibility requirements are not met, or materials and information required on the registration form are not provided.
  3. There is no fee to participate in a This Place Matters competition and no penalty is assessed if project groups do not meet their stated crowdfunding goal.
  4. The National Trust will retain 8% of all contributions to cover the cost of credit card transaction fees and to offset the costs of administering funds and maintaining the website.   1. The intent of This Place Matters is that all project groups participating in a competition are on an even playing field. The lead project group cannot make a financial contribution to their own crowdfunding campaign and any funds already in hand cannot be used towards the competition.
  2. Total contributions to each project, less 8% will be transferred to the project groups within 15 business days after the close of a crowdfunding campaign.
  3. Each project group will be assigned a Project Page on This Place Matters. Project groups may edit copy, and add photos and videos to their Project Page throughout the campaign period.
  4. Project Groups shall not post any false, misleading, or inaccurate information in connection to their crowdfunding campaigns or to the projects they are raising funds for.
  5. Use of Materials Posted to Project Groups’ Project Pages:
  1. By participating in a competition, the project group grants the National Trust authorization to reproduce, distribute, display and create derivative works of materials posted to the project group’s Project Page in connection with a crowdfunding campaign and promotion of This Place Matters, as well as in any media, without compensation to the Entrant. Credit will be given where possible.
  2. By participating in a competition, the project group grants the National Trust authorization to reproduce, distribute, display and create derivative works of the entry to promote the National Trust in social media, on their website and in print, without compensation to the Entrant. Credit will be given where possible.

Data Privacy:

 

By participating in a competition on This Place Matters the project group consents to the collection, use and distribution of information provided to the National Trust for the purposes of implementing, administering and fulfilling a crowdfunding campaign. The National Trust will not sell or transmit this information to third parties except for the purposes of administering the crowdfunding campaign

 

Section D: Rules & Regulations for Competitions

 

  1. The 2017 This Place Matters competition [the competition] is presented by the National Trust for Canada [the National Trust].
  2. Competition Website
  3. The competition website is owned by the National Trust. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans, representations and photographs are owned by the National Trust.   4. Competition Period
  1. The Competition begins on Thursday, June 15, 2017 at 12:00PM Eastern Time [ET], and closes on Monday, July 20, 2017 at 12:00PM ET.

For Project Groups

 

Eligibility Requirements:

 

  1. Project groups wishing to participate in the competition must meet the following eligibility requirements.

PROJECT GROUP & PROJECT PARTNER ELIGIBILITY:

  1. Projects must be submitted by a Lead Project Group that is a not-for–profit organization, registered charity or First Nations government.
  2. The Lead Project Group must own the historic place or have a written agreement in place with the owner or appropriate governing body, giving the Lead Project Group the responsibility and authority to carry out the proposed project.
  3. Lead Project Groups must have at least one Project Partner that will take on a defined role during the THIS PLACE MATTERS competition or during the implementation of the project. Project Partners can be any of the organizations eligible as Lead Project Groups as well as downtown business improvement organizations and municipal governments.

 

Please note that Lead Project Groups must provide a letter of support from the Project Partner confirming their involvement in and endorsement of the project as part of the application process.

PROJECT IDEA ELIGIBILITY:

  1. The following types of project ideas are eligible:
    1. Projects that will protect, restore or adapt a historic place.
    2. Projects that will connect the community and visitors to the history, heritage and cultural diversity of a historic place, through new visitor experience tools or amenities.

A “historic place” is any place with local cultural or historical value to the community.  Formal heritage designation is not a requirement for THIS PLACE MATTERS.

  1. Projects that involve protecting, restoring or adapting a historic place will be expected to respect heritage character. Please refer to the Standards and Guidelines for the Conservation of Historic Places in Canada.
  1. Projects such as apps and visitor amenities will only be eligible for THIS PLACE MATTERS if the project gives priority to essential work required to secure the health and preservation of the historic places. (For example, if the roof is failing, the Project Group should focus attention there).
  1. Projects must take place in Canada.
  1. Project Groups must be in a position to demonstrate progress on the project within six months following announcement of prize winnings by the National Trust, and projects must completed by December 31, 2018 .

 

Entering the Competition:

 

  1. Project groups are invited to submit a project idea to be considered for the 2017 This Place Matters competition. Project groups are required to fill in the project idea submission form.
  2. The National Trust reserve the right to disqualify the project group if any of the eligibility requirements are not met, or materials and information required on the submission form are not provided. If rejected, the Project idea will not move on to the competition.
  3. Obtaining votes by any fraudulent or inappropriate manner, tampering with or abusing the competition voting process by any means including the use of mechanical or automated programs to submit votes, on the part of a project group, will result in disqualification of those votes and/or from the competition at the discretion of the National Trust.
  4. No entry fee is required to enter the competition.
  5. There are eight prizes (one National, three first place regional, two second place regional and one, community builder) for a total of $220,000 in prizes for project. Regions will be defined as follows: East (New Brunswick, Nova Scotia, Newfoundland & Labrador, and Prince Edward Island), Central (Ontario and Quebec), West (Manitoba, Saskatchewan, Alberta, British Colombia, Yukon, Northwest Territories, Nunavut). There must be a minimum of three projects in each category. If there is not three, those projects will be added into the closest geographic region. Each project can only win one prize- either National, Regional or community builder within each project stream.

Use of Materials Posted to Project Groups’ Webpages:

  1. By participating in the competition, the project group grants the National Trust authorization to reproduce, distribute, display and create derivative works of materials posted to the project group’s webpage in connection with the competition and promotion of the competition, as well as in any media, without compensation. Credit will be given where possible.
  2. By participating in the competition, the project group grants the National Trust authorization to reproduce, distribute, display and create derivative works of the entry to promote the National Trust in social media, on their websites and in print, without compensation to the project group. Credit will be given where possible.

Cash Prizes:

  1. The total number of cash prizes available to be won is eight (8). The total value of the cash prizes available to be won is $220,000.
  2. Each dollar donated using our website will count for one (1) vote to the project.
  3. Cash prizes are awarded based on the number of votes received for each prize category as outlined below.

  1. In the event of a tie for 1st place, the 1st and 2nd place projects will be decided by a coin toss conducted with the project groups by phone.
  2. Cash prizes are not transferrable and can only be used for those projects entered in the competition.
  3. The winners of the cash prizes will be announced on the website by 12:00pm [ET] on July 24, 2017.

Distribution of Cash Prizes:

  1. The National Trust will notify the official representatives for the winning project groups by e-mail by 12:00pm [ET] on July 21 2017.
  2. Before the prize is awarded a person authorized by the project group must sign:
  3. A full release and indemnity form stating that the project group has read and understood all the Rules & Regulations of the competition and grants all consents required; and
  4. A Project Agreement establishing the project reporting requirements and disbursement schedule.
  5. Facsimile and e-mail with electronic signature will be accepted for both documents.
  6. Failure to sign either of these documents will result in the disqualification of the project group and the cash prize will be awarded to the project group that received the next highest.
  7. 50% of the cash prize will be transferred to the winning project groups upon execution of the Project Agreement. The remaining 50% will be transferred according to the disbursement schedule specified in the Project Agreement. Projects must be completed by December 31 2018

Fundraising on the Project Groups’ Webpages:

 

  1. Project Groups are permitted to solicit contributions from visitors to the competition website to support their projects on their webpage from the launch of the competition on June 15 2017 until July 20 2017. The total amount of contributions to each project will be tallied in real time on their respective webpages.
  2. The National Trust will retain 8% of all contributions to cover the cost of credit card transaction fees and to offset some of the costs of administering funds and maintaining the website. .
  3. Total contributions to each project, less 8% will be transferred to the project groups as soon as possible after July 20 2017.
  4. Only the total number of votes cast for projects will determine the winners of the cash prizes.

 

For Voters:

Voting Process:

  1. Anyone may vote for their favourite project. Voters must first register a first and last name and an email address in order to place a vote.
  2. Votes are cast online at www.thisplacematters.ca.
  3. Each voter is allowed one vote per 24 hours per project.
  4. Only those votes cast during the competition period will be tallied.
  5. Total votes for each project will be tallied in real time on the project groups’ webpage.
  6. Use of mechanical or automated programs to submit votes for this Competition is strictly prohibited. If any person is found to be tampering in any way with the voting process, those votes will be disqualified.
  7. There is no fee or obligation to the National Trust for voting in the competition.
  8. For every dollar contributed, one vote will be tallied to that same project idea.

By voting in the competition, the Voter consents to the collection, use and distribution of any personal information provided to the National Trust for the purposes of implementing, administering and fulfilling this competition. The National Trust will not sell or transmit this information to third parties except for the purposes of administering the competition.
  2. By voting in the competition, the Voter consents to the manner of collection, use, and disclosure of any personal information provided as set out in the National Trust’s Privacy Statement which is available at https://www.nationaltrustcanada.ca/privacy-notice.
